The most striking characteristic of an American nation is optimism. And the main aim of different political, cultural and financial structures is to maintain American optimism on the higher level. That is why there are so many laws, services and other things which were created to help those people who got into some difficulty, who made mistakes and went broke. This is because a person should always have a right to a second chance, a right to get back on his/her feet and have a good credit again. This is why a non-prime auto-financing industry exists. But are they always so helpful they kick and scream to be? Or do we unfairly misjudge them to justify ourselves?

Auto-financing companies and their customers. Different medias are flashing with furious complaints against such companies as Arcadia Financial, Triad Financial, Drive Financial. Offended customers bring a lot of proofs of their abuse.
• Creditors mess up the repayment system and customer’s credit history. You repay your usual monthly amount and after awhile they call you and say you are behind your payment and they did not receive any money from you. While you are trying to clarify the situation, the time is flying – and here, you have different late fees and interests on your credit. Finally, you are paying for their mistake.
• Their tactics in pulling your money from you is outrageous. If you are even one day late, they will never agree on some arrangements and keep on calling all your phone numbers unlimited number of times, being rude, argumentative and really offensive.
• Created as a company to help you get out of troubles, they are never supportive, never helpful in setting up some kind of compromise. They will make your credit score lower than ever. They just try to find more ways to get money out of you – like in Arcadia Financialyou are even charged simply paying over the phone! And when you have some questions, customer service and their managers are useless when it comes to answering.

Filing a law suit. When their behavior and constant calling brings you to the point of suing, you have to take a sober look at things. If you have an overdue payment, you cannot expect the creditor not to react, not to ask any questions. And their annoying calling is their reaction, besides it is completely legal as you have two ways to stop it: to make accurate payments or to give the car back. Because according to the contract you sign, any slightest misstep you as a person with limited or below average credit history take, may lead to the repossession. Thus, it will be reasonable to file if you have real material proofs of harassing or illegal activities.
